It is the first time that Brussels uses the constitutional procedure, a power which it has since 2014. The step which has now been taken is called a Opinion and serves to make the concern official. That would actually happen last week, but was postponed because there were signs it was a solution in sight.

If Poland does not come with an adequate response, Brussels can make recommendations, such as the imposition of a deadline to modify the criticized laws. If the Eastern European country who does not follow it would be right to vote can be lost in the EU (temporarily).

Poland is not exactly enamored of European criticism and recently suggested to go to the European Court of Justice to have the lawfulness of the Brussels decision.
