luxembourg - The manager of a fan page on Facebook is equally responsible for the protection and processing of personal data of its visitors as Facebook itself. According to the European Court of Justice, an administrator can not hide behind the fact that he uses the services of Facebook. The supervisor in the country of the administrator of the fanpage may intervene if the administrator violates the EU rules for data protection.

The Court ruled in a case filed by the German Wirtschaftsakademie Schleswig-Holstein, a private company that offers education services via a fan page on Facebook. The German regulator had ordered the company to deactivate the page because neither the company nor Facebook had informed the visitors that Facebook with cookies collected personal information about them and that they subsequently processed this information.

Facebook has been under heavy attack for months because it was messy and commercial with the personal data of the users. With this statement, responsibility for privacy is also partly placed with managers of Facebook pages.
